Terms of Service
Article 1 - Purpose
These Terms of Service (hereinafter "Terms") define the terms and conditions of use of the ComposeMeNow service (hereinafter "the Service"), accessible at www.composemenow.com, published by Locordi.
Registration and use of the Service implies full and complete acceptance of these Terms.
Article 2 - Description of the Service
ComposeMeNow is a SaaS (Software as a Service) platform that allows users to:
- Create and manage automated newsletter agents
- Generate newsletter content using artificial intelligence
- Manage a subscriber list for their newsletters
- Send newsletters to their subscribers
- Track open and click statistics
Article 3 - Registration and User Account
3.1 Access to the Service requires creating a user account.
3.2 The user agrees to provide accurate and up-to-date information during registration and to keep it updated.
3.3 The user is responsible for the confidentiality of their login credentials and all activities carried out from their account.
3.4 The user agrees to immediately inform Locordi of any unauthorized use of their account.
Article 4 - Use of the Service
4.1 The user agrees to use the Service in accordance with its intended purpose and these Terms.
STRICTLY PROHIBITED CONTENT
4.2 It is STRICTLY FORBIDDEN to use ComposeMeNow to distribute:
- Terrorist content or glorification of terrorism
- Racist, xenophobic or discriminatory content
- Incitement to hatred against individuals or groups
- Child pornography or exploitation of minors
- Incitement to violence or murder
- Harassment or cyberbullying
- Holocaust denial or revisionist content
- Scams, phishing or fraud
- Content threatening national security
SANCTIONS: Any account distributing this type of content will be IMMEDIATELY AND PERMANENTLY TERMINATED without notice, without refund, and will be reported to the competent authorities.
4.3 COOPERATION WITH AUTHORITIES
Locordi fully cooperates with law enforcement and judicial authorities. Any judicial requisition or request from competent authorities (police, gendarmerie, justice) will be honored within legal deadlines. Connection data and newsletter content may be transmitted upon official request.
4.4 It is also prohibited to use the Service to:
- Send unsolicited emails (spam)
- Collect email addresses without consent
- Violate third-party intellectual property rights
- Impersonate a person or organization
- Attempt to circumvent Service security measures
- Use the Service for fraudulent purposes
4.5 The user is solely responsible for the content they generate and send via the Service.
Article 5 - Email Regulation Compliance
5.1 The user agrees to comply with applicable email regulations, including:
- General Data Protection Regulation (GDPR)
- ePrivacy Directive
- Data Protection Laws
- CAN-SPAM Act (for US recipients)
- CASL (for Canadian recipients)
- Any other applicable local regulations
5.2 USER'S INTERNATIONAL RESPONSIBILITY
The user is solely responsible for ensuring that their newsletters comply with the laws and regulations in force in all countries where their recipients reside. The user must ensure that the content of their newsletters respects the local legislation of each destination country, particularly regarding:
- Personal data protection
- Consumer law and advertising
- Freedom of expression and its limits
- Intellectual property
- Sector-specific regulations (health, finance, etc.)
Locordi disclaims any responsibility in case of non-compliance of content sent by the user with the regulations of destination countries.
5.3 The user guarantees that they have explicit consent from their subscribers to send them emails.
5.4 The user agrees to include a functional unsubscribe link in each newsletter.
5.5 The user agrees to maintain an up-to-date subscriber list and to immediately honor any unsubscribe request.
Article 6 - Intellectual Property
6.1 The Service, its interface, features and source code are the exclusive property of Locordi.
6.2 The user retains intellectual property rights over the content they create and the data they import.
6.3 Content generated by artificial intelligence belongs to the user who generated it, subject to respect for third-party rights.
Article 7 - Liability
7.1 Locordi undertakes to implement all necessary means to ensure the availability and security of the Service, without obligation of result.
7.2 Locordi cannot be held liable for indirect damages resulting from the use or inability to use the Service.
7.3 The user is solely responsible for the use they make of the Service and the content they generate and distribute.
Article 8 - Suspension and Termination
8.1 Locordi reserves the right to suspend or terminate access to the Service for any user who does not comply with these Terms, without notice or compensation.
8.2 The user may terminate their account at any time from their account settings.
8.3 Upon termination, the user may request export of their data within 30 days.
Article 9 - Modification of Terms
Locordi reserves the right to modify these Terms at any time. Users will be notified by email of any substantial modification. Continued use of the Service after notification constitutes acceptance of the new Terms.
Article 10 - Applicable Law and Jurisdiction
These Terms are governed by French law. In case of dispute, and after an attempt at amicable resolution, the competent courts within the jurisdiction of the Versailles Court of Appeal shall have sole jurisdiction.
Article 11 - Applicable Local Law
These Terms of Service are based on French law. However, if you are located in a country with different laws (USA, UK, Canada, Australia, etc.), additional rules may apply. You are responsible for ensuring that your use of our Service complies with the laws applicable in your country of residence. ComposeMeNow cannot be held liable for non-compliance with local regulations that would apply to your specific situation.
